Terms and Conditions For Prison, Jail, and Correction Center Notary Signings


Introduction


S. D. Walker & Company LLC, herein referred to as "The Company," requires the Service Initiator, hereby known as "The Client," to agree to the following terms and conditions for notary services. The Client is the person initiating services on behalf of an inmate (i.e., beneficiary or acting agent). All payments are payable by The Client.


Payment Policies


1. **Non-Refundable Fees:**

All appointment fees, copy fees, courier fees, witness fees, filing fees, processing fees, notarial act fees, and travel fees are NONREFUNDABLE.

A fee paid for one document cannot be transferred or applied to another document. For example, if you pay for a Notarial Act and then change your mind to notarize a different document, the notarial fee for the first document cannot be transferred or applied to the different document.


2. **Appointment Fees:**

Due to the unpredictable circumstances of inmate visitations, the appointment fee will not be refunded once the terms and conditions are agreed to. The appointment fee must be paid upfront prior to the start of services.


3. **Final Balance Payment:**

The final balance of the signing cost is due after documents have been confirmed signed via text pictures to The Client.  No documents will be released until full payment is received, no exceptions.


4. **Payment Methods:**

Payments can be made electronically via credit card, Zelle, PayPal, CashApp, Venmo, and/or payment links. See invoice for all electronic payment links.


Cash is also accepted; however, no personal checks or money orders are accepted, business(from partners) and cashier checks are accepted.


5. **Rescheduling and Additional Fees:**

If an inmate visit is denied by the Department of Justice (local, state, and/or federal) agencies, there will be a one-time rescheduled appointment at no additional cost to The Client.

If the inmate refuses to sign at the appointment and/or the appointment is canceled due to negligence on the part of the inmate or The Client, an additional appointment fee will be assessed to the cost.


Process and Expectations:


Please note that this process can take all day due to the rules and regulations of the facility, which The Company and the inmate are subject to. The Company will do all within its power to complete the signing; however, we cannot promise that the process will be expedited or completed on the initial day of the appointment.


Special Accounts:


If you are a bail bondsman, lawyer, or title company and wish to create a MOD account or a retainer on file account, please contact the billing department and process a Service Request Form to set these accounts up.


Acknowledgment:


By initiating service with S. D. Walker & Company LLC, you acknowledge that you have read, understood, and agreed to these terms and conditions.

Terms and Conditions for Notary, Apostille, and Courier Services 


Introduction: 

S. D. Walker & Company LLC, herein referred to as "The Company", requires the Service Initiator, hereby known as "The Client", to agree to the following terms and conditions when engaging The Company for notary services, apostille processing, and courier deliveries. These terms are designed to protect the time, labor, and resources of The Company and ensure mutual understanding of limitations beyond our control. 


Payment Policies:

  1. All Fees Are Paid Upfront All service fees must be paid in full before any work begins, regardless of whether the client is an individual, business, or organization. No exceptions. 
  2. Non-Refundable Fees All appointment fees, copy fees, courier fees, apostille agent fees, notarial act fees, travel fees, witness fees, filing fees, and processing fees are NON-REFUNDABLE, even if documents are rejected, canceled, or delayed due to circumstances outside of The Company's control. 
  3. Fee Application Fees paid for a specific document or service cannot be transferred to another. For example, if you pay for a courier delivery and later change the destination or purpose, additional charges may apply. 
  4. Final Payment Requirement No documents will be delivered, mailed, or released until full payment is received. Confirmations or updates via text, email, or photo do not equate to the release of final documents. 
  5. Accepted Payment Methods We accept payments via credit card, Zelle, PayPal, CashApp, Venmo, and payment links. Cash is accepted in person. No personal checks or money orders are accepted. Business checks (from approved partners) and cashier's checks are permitted. 
  6. Rescheduling & Additional Charges If an appointment must be rescheduled due to client error (e.g., incomplete documents, no-shows, lack of certified copies), an additional appointment fee will be assessed. No exceptions.


Partner Companies & Retainer Accounts:

  1. Companies wishing to establish a Partner Account must maintain a retainer balance between $500 and $1,000, based on the anticipated monthly volume of service.
  2. The retainer must be funded and maintained before any services are rendered. 
  3. If the cost of services exceeds the available retainer balance, The Company will perform services only up to the value of the current balance. The remainder must be paid upfront for additional services.
  4. Net payment terms (e.g., Net 15, Net 30) are not permitted. All fees are paid upfront or drawn from the active retainer account. 
  5. Failure to maintain an active balance may result in a temporary suspension of partner privileges or delay of services. 


Service-Specific Disclaimers & Limitations Notary Services: 

  1. The Company performs general notarial acts according to the laws of the State of Arizona.
  2. The Clients are solely responsible for ensuring documents are completed and ready for notarization. The notary cannot complete or correct  documents on the client's behalf. 
  3. Identification is required for all signers. Expired, damaged, or invalid IDs will result in appointment termination, and fees will not be refunded. 


Courier Services:

  1. Courier services are completed based on the time/date agreed upon and do not guarantee same-day or expedited filing unless arranged and paid for in advance.
  2. The Company is not responsible for lost, delayed, or mishandled documents by third-party shipping carriers or government agencies. Apostille Services 
  3. Apostille processing is subject to the hours, closures, and processing times of the Secretary of State, Department of State, and any other relevant agencies. 
  4. No refunds will be issued due to agency closures, system failures, or staffing delays at government offices. 
  5. The Company is not liable if a document is rejected due to: 
  6. Errors in the originating document. 
  7. Missing or improper notarization.  
  8. The destination country rejecting the apostille, even if it was properly issued by the originating country. 
  9. If the destination country requires certified copies or additional supporting documents, the client is responsible for providing them. We do not guarantee acceptance by foreign consulates or embassies. 


Client Responsibility & Company Protections: 

  1. The Client is solely responsible for ensuring all documents are properly prepared before submission to The Company. 
  2. The Company is not responsible for errors or omissions in documents provided by The Client or third parties. 
  3. Rejections by any agency due to incomplete or improperly prepared documents do not qualify for refunds. 
  4. Delays caused by government closures, system outages, natural disasters, shipping carriers, or political events are out of The Company's control and do not constitute grounds for refunds or discounts. 
  5. The Company's role is limited to facilitation. Once a document is accepted by the agency, The Company is not liable for how that document is used, interpreted, or accepted by the end recipient or foreign entity. 
  6. By using our services, you agree not to hold The Company liable for outcomes or decisions made by any government, consulate, embassy, or third-party institution. 


Acknowledgment:

By initiating service with S. D. Walker & Company LLC, you confirm that you have read, understood, and agreed to these Terms and Conditions. You also acknowledge that fees are due regardless of document outcome if caused by external or client-side factors.

DIAMOND PROGRAM

PARTICIPATION AGREEMENT (Required Before Services Begin)

Before proceeding with the intake process, you must read and agree to the terms of this legally binding Participation Agreement. You will not be able to submit your intake form until all required boxes are checked and the agreement is signed.


SECTION 1 – INTRODUCTION

This Diamond Program Participation Agreement (“Agreement”) is a legally binding contract between S. D. Walker & Company LLC (“The Company”) and you (“The Client”).
By agreeing below, you acknowledge that:

  • The Company assists with the preparation and submission of Good Cause Exception and Central Registry Exception applications.
     
  • The Company does not control decisions, processing times, or outcomes made by the Arizona Department of Public Safety (DPS), the Arizona Fingerprint Board, or the Central Registry Unit.
     
  • All timelines, responsibilities, and requirements in this Agreement must be followed.

SECTION 2 – SERVICES COVERED BY THIS AGREEMENT

SECTION 3 – PAYMENT, REFUND, & FEE POLICIES


3.1 No Refund Policy

All payments made to S. D. Walker & Company LLC are final and non-refundable due to the time-sensitive and labor-based nature of research and application preparation.


3.2 Client Disclosure Requirements

You agree that you have disclosed all known criminal charges, arrests, and court cases.
Failure to disclose any information will require additional fees and may delay your application.


3.3 Optional FBI Rap Sheet Fee

Please select one:
☐ I ACCEPT the optional FBI Rap Sheet request and understand there is an additional fee.
☐ I DECLINE the optional FBI Rap Sheet request.

☑ I agree to all payment terms and understand the no-refund policy.


SECTION 4 – CLIENT RESPONSIBILITIES


4.1 Full Disclosure (Softened Version of Option C)

You certify that you have disclosed all criminal charges, arrests, court cases, and agency involvement to the best of your knowledge.

☑ I understand that incomplete disclosure may delay my case or require additional fees.


4.2 Communication Requirements

You agree to respond to all Company emails within the timeframes listed in this Agreement.

☑ I agree to respond within required timelines.


4.3 Document Submission Responsibilities

You must forward all records received from courts, police departments, CPS, DDD, or other agencies.

☑ I understand I must forward documents promptly when received.


SECTION 5 – PROCESS & EXPECTATIONS


5.1 Step 1 – Fingerprint Appointment

Your process begins after your fingerprints are submitted to DPS.

5.2 Step 2 – Submit Denial Letter (within 30 days)

Your denial letter must be emailed to the Company within 30 days.
No research can begin until the letter is received.

☑ I acknowledge Step 2 and the 30-day requirement.


5.3 Step 3 – Queue Notification

When you reach third in the queue, we send preparation instructions.

☑ I acknowledge Step 3.


5.4 Step 4 – Research Phase Begins

Research begins ONLY when:

  1. You reach the appropriate queue position, AND
     
  2. Your denial letter is on file.
     

Research may include contacting:

  • Arresting agencies
     
  • Courts
     
  • Police departments
     
  • CPS, DDD, or similar agencies (Central Registry clients only)
     

☑ I acknowledge Step 4 and understand when research begins.


5.5 Step 5 – Forward Records (within 2 months)

You must forward all received documents within 2 months.

If we do not hear from you within 2 months:

  • We will send a 5-day notice
     
  • Failure to respond will result in case closure
     
  • A fee will be required to reopen your case

5.6 Step 6 – Reference Letters (within 15 days)

Two reference letters must be submitted within 15 days when requested.

☑ I acknowledge Step 6.


5.7 Step 7 – Testimonial Statements (within 15 days)

Statements for each charge must be submitted within 15 days.

☑ I acknowledge Step 7.


5.8 Step 8 – Final Appointment

Scheduling occurs only after all documents are received.

5.9 Step 9 – Submission to DPS Board / Central Registry

Your completed application will be submitted to:

  • Arizona Fingerprint Board (Good Cause Exception)
     
  • Central Registry Unit (Central Registry Exception)
     

You acknowledge:

  • There are no expedited services
     
  • The Company cannot influence agency timelines
     
  • Approval is not guaranteed

SECTION 6 – CASE FILE CLOSURE & DOCUMENT HANDLING

If your case is closed due to inactivity:

  • Paper documents will be mailed to your last known address
     
  • The Company does not keep paper files
     
  • Reopening a case requires an additional fee

SECTION 7 – LIABILITY LIMITATION (Softened Option C)

You agree that The Company is not responsible for:

  • Delays by DPS, the Fingerprint Board, courts, CPS, DDD, police agencies, or mailing services
     
  • Delays caused by reference letter writers
     
  • Employment or financial impact resulting from agency delays

SECTION 8 – DISPUTE RESOLUTION (Arbitration)

Any dispute arising under this Agreement will be resolved through binding arbitration in Maricopa County, Arizona.

SECTION 9 – GOVERNING LAW

This Agreement is governed by the laws of the State of Arizona.
